Smart Glass Warranty

We offer a three (3) year warranty on our smart glass products.

Smart Glass Country guarantees and warrants, to the original purchaser, that our switchable PDLC glass products shall be free from any defects and any significant obstruction to vision due to dust or moisture on the interior glass surfaces, resulting exclusively from a failure of the sealing, defects in workmanship or the material life of the product. Smart Glass Country guarantees the normal functioning of its transformers.

This warranty is subject to the conditions and limitations stated below, and only for so long as the original owner owns and resides in the home where the windows and doors are installed.

If any such failure occurs, Smart Glass Country will, at its discretion, will send a replacement unit, without charge, make repairs, or provide a refund equal to the cost of a replacement unit.

Smart Glass Country is not responsible for the cost of labor, installation, sales tax, import duties, finishing, or any other associated or incidental cost, for either the original smart glass unit or its replacement.
The warranty period will not be extended by any replacement or repair.

As of March 1st, 2022 we require all warranties to be registered in order to be valid.

***Please note that smart glass cannot be left in the 'ON' state for longer than 72 hours (3 days) or it may begin to damage the switchable interlayer***

Exclusions:
This warranty does not cover conditions that are not product defects or are caused by factors beyond Smart Glass Country’s control, including without limitation:

-The unit is cracked, shattered, broken or damaged for any reason.
-The unit is not installed or maintained in accordance with Smart Glass Country’s installation manual and applicable architectural or building standards.

Non-standard installation, including without limitation, units installed in non-vertical planes, sloped glazing or out-of-square. The unit is subjected to stresses, including without limitation, stresses from architectural settlement or vibration, soils movement, or other movement of the foundation, localized application of heat causing excessive temperature differentials over the glass surfaces or edges, or exposure to corrosive materials, including without limitation, chlorine or sulfur. The unit is subjected to high humidity. Improper weeping resulting in the accumulation of moisture or water. Minor glass imperfections that are allowable under ASTM or other industry standards.Condensation, frost, mold, mildew, corrosion or fungus on glass surfaces. Temporary thermal expansion or bowing caused by direct sunlight or the differential between indoor and outdoor temperatures. Defects in exterior finishes that result in peeling or cracking. Aftermarket coatings, films or tints have been applied to the unit. The unit has been modified or altered by the original purchaser or any other third-party. The unit has been exposed to extreme weather, atmospheric conditions or force majeure. The unit was installed at a high altitude without capillary tubes or has capillary tubes but was not installed in a high-altitude application. Decorative art glass is sealed between the panes. The unit has been improperly used or maintained.

Disclaimers and Limitations

Disclaimers:

The Smart Glass Warranty is the exclusive warranty offered by Smart Glass Country with respect to its switchable glass products. Smart Glass Country expressly disclaims all other representations, warranties, conditions or covenants of any kind, either statutory, express, or implied including without limitation, any implied warranties of merchantability or fitness for a particular purpose, use, condition, climate, durability, or suitability for a particular project or design.
In the event that state or provincial law precludes exclusion or limitation of implied warranties, the manner of presenting any claim thereon will be the same as that provided in the express warranty stated herein.

Limitations:

Smart Glass Country will not be liable for any incidental, consequential, indirect, special, contingent, or punitive damages for:
(i) any claim, whether based on a breach of warranty, breach of contract, tort, strict liability or otherwise;
(ii) the tender of defective or non-conforming goods;
(iii) breach of any other provision of this limited express warranty;
(iv) claims arising from contracts between Smart Glass Country’s registered dealers and their customers, agents, employees, subcontractors, end-users or other third- parties; or
(v) any loss or claim, including without limitation, water intrusion and related damage, arising out of or in connection with any third-party recommendation, installation, modification or repair. in no event will Smart Glass Country’s liability exceed the purchase price paid for the subject product or component.

No distributor, dealer, employee or representative of Smart Glass Country may change, extend, or in any way modify this Smart Glass Warranty, either orally or in writing, and any such modification will have no force or effect.

Suitability

Smart Glass Country is not responsible for determining the suitability of any product for a particular project, design, application, climate, condition, use, or customer need or purpose. Smart Glass Country is also not responsible for determining whether the incorporation of its products into a building design will achieve a particular third-party certification or standard as windows and doors are only one factor in the building envelope. Determining such product suitability is the responsibilityof the architect, contractor, Registered Dealer, installer, owner, user, and/or other construction professionals. Smart Glass Country will also not be responsible for any claims or damage arising from inappropriate selection of products, faulty building design or construction, improper installation, or inaccurate orders.Smart Glass Country also does not control the application or selection of its product configurations, sealant, or glazing materials and assumes no responsibility therefore. It is the responsibility of the architect, contractor, Registered Dealer, installer, owner, user, and/or other construction professionals to make these selections in strict compliance with applicable laws and codes. These limitations of warranty and liability shall survive and apply, even if the exclusive remedy described in this Smart Glass Warranty is deemed to fail for its essential purpose.

CONDITIONS AND PROCEDURES

Procedures:
Claims under this warranty must be made via email to info@smartglasscountry.com and include:
(1) your name, address, and telephone number;
(2) proof of purchase;
(3) Smart Glass Country order number;
(4) the date the alleged condition was first observed; and
(5) a specific description of the alleged condition.


For any warranty to be valid the following must have occurred.
a) retain a copy of the original quote/signed estimate or (invoice)
b) pay the full contract price of our service
c) pay in full any other invoices outstanding with seller
d) retain a copy of your cancelled check or other evidence of full payment from any electronic payment method
e) The buyer must provide proof of product defect by means of video and pictures that justify the warranty claim.

All warranty claims must be made as soon as practicable after discovery of the alleged condition and in all events within the applicable warranty period and prior to the beginning of any repair work. Smart Glass Country reserves the right to inspect any and all units alleged to be defective, including but not limited to having the unit returned to the factory for inspection and/or testing, prior to making any determination as to whether a covered defect exists or authorizing any repair or replacement hereunder.

Smart Film Warranty

Smart Glass Country offers a warranty up to three years for our switchable PDLC film. This warranty takes effect upon the delivery of the product and does not cover any damages incurred during shipping or storage, so it is important to inspect the film within 24 hours of delivery.***Please note that smart film cannot be left in the 'ON' state for longer than 72 hours (3 days) or it may begin to damage the switchable interlayer

***Guarantees:

Our warranty includes the following guarantees:Normal functioning of the smart film and consistency of the desired effect, going from clear to frosted, when powered on and off.Proper functioning of the transformer.

Exclusions:

Smart Glass Country does not cover defects, breakage or product failure caused by:Improper or negligent use of the product. Alterations or modifications not made by Smart Glass Country.Improper or incomplete installation, unless the installation was performed by Smart Glass Country.Installation that did not follow our instructions and recommendations. The use of sealants or chemicals that were not approved by Smart Glass Country during installation and maintenance.The application or attachment of unapproved materials and coatings to the film.Exposure of the film and transformer to an electrical surge. Electrical work, wiring or integration systems that proved to be inadequate and were not specified or previously approved by Smart Glass Country. External causes, acts of a third party, vandalism, natural catastrophe and, generally, any event of force majeure.This warranty is non-transferable: The warranty hereunder is provided by Smart Glass Country exclusively to the client and cannot be transferred to a subsequent acquirer of the product.ProcedureAny communication concerning the smart film warranty provided by Smart Glass Country must be emailed to info@smartglasscountry.com. In order for the warranty to be honoured, the client must return the product to Smart Glass Country via prepaid transport.No warranties will be enforced and no exchanges will be made if the privacy film has been cut, bent, dented, kinked, scratched, gouged, if the protective liner has been peeled off, or if the film is in poor condition.If the failure of or defect in the product is covered by the warranty, Smart Glass Country will either repair the product, replace it with a product of the same or higher quality or reimburse the client, in each case at no additional cost to the client.Labor costs associated with the removal, installation or reinstallation of the product are not covered by this warranty.

Each piece of smart film is custom-made for the client. Therefore, the order cannot be cancelled following confirmation under any circumstances, nor can the client be reimbursed for any cancelled order.

How To Maintain Smart Glass and Smart Film

Keep your smart glass and film performing at its best. With simple maintenance, your glass windows, walls and doors will offer privacy on demand for many years to come. Here is some information and tips on inspecting, installing, cleaning and maintaining our switchable glass products.

Cleaning Smart Glass and Film

Smart glass is cleaned just like regular glass with alcohol or glass cleaner.Smart Film should be cleaned with a soft cloth and isopropyl alcohol (70% alcohol or rubbing alcohol that you can buy in any drugstore).Important Precautions:Always power the film off when cleaning and do not turn it back on until it is completely dry.Do not allow any metal or hard parts of the cleaning equipment to come into contact with the film.The surface of the privacy film can become marked or scratched if cleaning instructions are not followed.Never clean electric privacy film with a wet cloth and bucket or other technique that drenches the surface of the film with water.

Annual Checks

Following installation, we recommend checking the privacy glass or film annually to ensure all wiring is in good working condition, framing materials are free of any damage and the transformer is operating well.Areas adjoining the glass such as walls, ceiling and floors should have their structural integrity, humidity and temperature checked. If there is excess heat or humidity it should be dealt with as soon as possible to preserve the switchable glass or film.If the edges were sealed with a silicon gel to keep moisture away, check to ensure the silicon is still in place and perform any necessary touch ups.
